1. GENERAL TERMS AND CONDITIONS

1.1. These Terms and Conditions determine the use of SIA SMARTECH (hereinafter referred to as the "Seller") online store(hereinafter referred to as the “Service”). If the user registers to receive the Service or makes a purchase using the Service (hereinafter referred to as the “Customer”) he agrees to Terms of Service and undertakes to comply with them.

1.2. Seller company data: SIA SMARTECH, registration number 40003686167, Kaudzisu iela 22, Rumbula, Stopinu pag., Ropazu nov., Latvia, LV-2121.

1.3. All rights to the content of the Service belong to the Seller. The Seller has the rights to make changes in these Terms and Conditions, which come into force when they are published. Terms and Conditions are available in the website https://agritex.lv

 

2. CUSTOMER INFORMATION

2.1. Customer - business or a private person.

2.2. Customer's personal information is gathered and kept in a database, complying to the legislation of personal data protection.

2.3. The Customer has the rights to change and delete his/her personal data from the registry. 

 

3. PRODUCT ORDER AND DELIVERY

3.1. The orders are being delivered in the Europen Union (Schengen Area) and Latvia. 

3.2. The prices on the website exclude VAT and delivery costs. 

3.3. Any price offer that is sent via the email is valid for 30 days. 

3.4. The Customer can make an order in the online store with or without registering the user account. The order is considered confirmed when the Customer receives approval from the Seller to the email stated in the order form. 

3.5. If all or some of the items aren't available in the warehouse at the moment of the order, and the Seller can't deliver them within the defined term, then the Seller must inform the Customer individually about the delivery time of these items. 

3.6. The goods shall be delivered if paragraph 4 is complied with.

3.7. The order can be received in SIA SMARTECH store, Omniva or DPD parcel machines or by courier delivery at the address provided by the Consumer.

3.8. All orders ar https://agritex.lv are processed on working days from 9:00 until 17:00. The orders made on Saturdays, Sundays and public holidays are processed on the next working day. It's applicable also for all orders with delivery status “Receive the order in Agritex store”. 

3.9. Receiving the order via parcel machine.

3.9.1. When delivering the order to the Consumer's chosen parcel machine, delivery costs are added to the product price. 

3.9.2. The Consumer is informed about the delivery to the chosen parcel machine by SMS message that is sent to the phone number provided by the Customer upon placing the order. The SMS message contains a unique door code that is necessary for opening the parcel machine locker.

3.10. Receiving the order with courier delivery.

3.10.1. When the order is delivered by the courier service, delivery costs are added to the product price 

3.10.2. The courier delivers order in five working day's time. The delivery takes place on working days from 10.00 until 21.00. Before delivery, the courier will contact the Consumer to agree on the exact delivery time. 

3.11. Inspection of goods. 

3.11.1. Upon receiving the goods, the Consumer undertakes to open the packaging without damaging the package or the goods. If the Consumer has negligently damaged the packaging when it could have been opened without damaging, SIA SMARTECH has the right to request compensation for the damage in case the Consumer returns the order back to SIA SMARTECH.

3.11.2. If upon receiving the goods, the Consumer finds that all or any of them are faulty or defective, not compliant with the order, or if the packaging is open (or damaged), the Consumer must immediately inform SIA SMARTECH about it via info@agritex.lv or +371 25643067. 

3.12. If the Consumer doesn't collect the product or service, the Seller undertakes to keep the goods for 90 days. After the end of the 90-day term, the Seller has the rights to sell the goods to cover the Seller's expenses and losses. 


4. PAYMENT FOR THE GOODS

4.1. When purchasing goods at https://agritex.lv, the Consumer must carefully fill in all the data necessary to make an order.

4.2. To make the payment, the Consumer chooses the preferable payment method on the website:

4.2.1. By cred card (Visa or MasterCard).

4.2.2. By pro forma invoice. If the Consumer chooses this payment method, the pro forma invoice will be prepared and sent to the Consumer's registered email. When making a payment, you need to include the invoice number in the payment details. The order will be delivered only after the full amount of the invoice will be received in the Seller's bank account.

4.3. The invoice is delivered to the Consumer along with the order. 


5. ORDER CANCELLATION AND RETURNS

5.1. The Customer can't cancel the order that is already placed and paid. The customers who are private persons and purchase goods for a purpose non-relatable to the business or professional activity (hereinafter referred to as the “Consumer”) have the rights of withdrawal pursuant to the clause 5.2. to 5.5. in these Terms and Conditions. 

5.2. The Consumer has the right to return the product within 14 days of the order being delivered. The product must be undamaged, unused, in its original packaging and in the appearance as intended for sale. The Consumer shall be liable for any diminished value of the product if it has been used in a manner incompatible with the principle of good faith, including the use for purposes other than ascertaining the nature or functioning of the product.

5.3. The Consumer shall inform the Seller about using the rights of withdrawal within 14 days time from receiving the products by filling in the withdrawal form and sending it to the Seller's Consumer service. The item must be returned to the Seller within 10 days time after receiving the withdrawal confirmation. 

5.4. In a case when the Consumer cancels the order that includes items that haven't been available or have been specifically ordered for the Consumer the Seller has the rights to apply the cancellation fee for the Consumer to cover the losses related to the cancellation. 

5.5. The product is considered to be returned when it has been delivered back to the Seller. 

5.6. The Consumer covers the expenses related to returning the products to the Seller. 

5.7. Product price shall be refunded to the Consumer not later than within 30 days from the date the written withdrawal was sent, provided that the products have been returned to the Seller and the conditions specified in clause 5.2. have been fulfilled. 

 

6. PRODUCT AND SERVICE QUALITY AND WARRANTY

6.1. The Seller provides warranty for the products and services for a period determined by the manufacturer's factory terms. 

6.2. The warranty period starts at the moment when the Seller delivers a product or service to the Customer. The Seller shall not compensate for the loss of revenue during the warranty period, as well as the costs related to product transportation. 

6.3. The product parts that have become unusable during the warranty period as a result of poor quality material, construction or assembly are replaced. The warranty doesn't cover the repair of the parts that have become unusable due to natural wear or improper use.

6.4. The warranty doesn't cover any defect caused by improper use, maintenance and other objective factors (humidity, increased temperature, natural wear, etc.), nor does it cover the costs caused by accidents or vandalism. The warranty is also void if the product has not been serviced in accordance with the Service Book, Operating Instructions, Terms of Use, or if the Customer has failed to comply with the clause 6.5., 6.6. and 6.7. of these Terms and Conditions.

6.5. If any defects are found while using the product, the Customer shall immediately stop its exploitation and contact the Seller. 

6.6. To confirm the warranty request, the product must be presented in a condition in which it was damaged.

6.7. Only the Seller can do the product maintenance, except in the situations when it is not possible due to the specifics of the product or damage.

 

7. PRODUCT DESCRIPTIONS

7.1. All samples, pictures, descriptions, specifications, advertisements and illustrations that are included in the Seller's catalogues or brochures are published only with an aim to provide a representation of the items described in it. Product images are for illustrative purposes only. 

 

8. OTHER TERMS AND CONDITIONS

8.1. The Seller shall not bear responsibility for delays that have occurred due to Force Majeure.

8.2. Disputes are resolved by negotiation. If they cannot be resolved by negotiations, they shall be dealt with in accordance with the procedure prescribed by the laws and regulations in force in the Republic of Latvia.
